Overview
Classify the item before deciding who owns it at transfer. The exam usually gives facts about attachment, adaptation, intent, the relationship of the parties, and the contract.
Core Concepts
- Real property includes land, improvements, and rights appurtenant to the land.
- Personal property (chattel) is movable property that is not part of the real estate.
- Annexation converts personal property into a fixture; severance can convert a fixture back into personal property.
Exam Tips
- Do not use 'attached = fixture' as the only test; trade fixtures and contract language are common exceptions.
- On crop questions, ask whether the crop is annual and produced by human labor.
