Classify property by asking whether an item is land/improvement, movable personal property, an ordinary fixture, a tenant trade fixture, or an annual crop (emblement).
Core Concepts
- Real property includes land and permanent improvements; personal property is generally movable.
- A fixture begins as personal property but becomes part of the real estate through annexation, adaptation, and objective intent; the parties’ agreement can control.
- Use MARIA-style factors as an analysis aid: method/degree of attachment, adaptation, relationship of parties, intention, and agreement; no single mechanical shortcut controls.
Exam Tips
- Start with the written agreement; then analyze annexation, adaptation, intent, and relationship.
- Do not let a seller’s last-minute stated intention override objective fixture facts.
