Master real versus personal property by learning the rule, the distinction it creates, and the fact pattern that triggers it.
Core Concepts
- Real property is land plus rights and permanent improvements/attachments; personal property (chattels) is movable.
- An item can change classification by annexation (personal to real) or severance (real to personal).
- Fixture questions turn on the parties’ agreement first; if silent, analyze method/degree of attachment, adaptation, relationship of the parties, and objective intent.
Exam Tips
- Read the final sentence first so you know what distinction or calculation the question is asking for.
- Underline role, timing, document, money type, and jurisdiction words; these are common decision triggers.
