Overview
Property-foundation questions test classification before conclusion. Identify whether the fact pattern involves real property, personal property, a fixture, an easement, a covenant, title vesting, or a government power before choosing the rule.
Core Concepts
- **Fixtures vs. personal property:** A fixture starts as personal property but becomes real property when attachment, adaptation, and intent show it should stay with the land.
- **Fixture inclusion in sale:** Built-in or permanently adapted items generally transfer unless the contract clearly excludes them; vague oral understandings create exam traps.
- **Unrecorded easements:** An unrecorded easement may still matter if a buyer has actual or inquiry notice, such as visible use or known access across the property.
Exam Tips
- For fixture questions, test attachment, adaptation, and intent before choosing who gets the item.
- If the fact pattern says “as joint tenants,” think survivorship; if it does not, do not assume survivorship.
